CENTRE FOR LEGAL EMPOWERMENT
Në 24 Nëntor, Gjykata e Lartë ka vendosur heqjen e licencës e kompanisë konçesionare për prodhimin e energjisë për HEC-in në Zajs. Ky vendim i Gjykatës së Lartë shënon një fitore në përpjekjen disa vjeçare të banorëve të Zall Gjoçaj në Mat dhe mbështetjes ligjore që Centre for Legal Empowerment i ka dhënë kauzës së drejtë dhe mjedisore të tyre. Prej vitit 2019, ne kemi qenë të angazhuar në mbështetje të banorëve të Zall-Gjoçaj të cilët, përmes rezistencës qytetare dhe asistencës ligjore nga aktivistët dhe avokatët tanë, kundërshtojnë ndërtimin dhe funksionimin e HEC-it në territorin e pasurisë natyrore të parkut “Lurë-Dejë”.
Centre for Legal Empowerment dhe avokatet e saj në sajë të angazhimit të pakursyer për kauzën qytetare dhe mjedisore njëkohësisht, kanë arritur të frenojnë përmes argumenteve të bazuara në ligj aktivitetin energjitik të HEC-it në fjalë. Ky rrugëtim ka njohur arritje dhe suksese të një pas njëshme në të gjitha shkallët e gjyqësorit në vend, duke u përballur dhe më vendime në disfavor të kauzës së drejtë të banorëve dhe komunitetit të Zall-Gjoçaj.
Centre for Legal Empowerment së bashku me avokatët dhe mbështetjen e aktivistëve dhe komunitetit lokal vijoi rezistencën bazuar në kërkesën e drejtë mjedisore. Fitorja e parë në këtë drejtim u shënua në Janar 2021, ku Gjykata Administrative e Tiranës shfuqizoi vendimin që licensonte kompaninë e kontraktuar për ndërtimin e hidrocentralit në zonën e mbrojtur, vendim që u la në fuqi nga Gjykata Administrative e Apelit në Nëntor 2021. Ndërtimi i HEC-it në Zais ndaloi, por përpjekja jonë për ta ndaluar atë përfundimisht, JO!
Në muajin Mars 2022, Gjykata e Lartë vendosi për pezullimin e ekzekutimit të vendimeve të Gjykatës Administrative të Shkallës së Parë Tiranë dhe Gjykatës Administrative të Apelit, vendim të cilin Centre for Legal Empowerment vendosi të kërkonte rigjykim.
Përpjekja jonë e pandalshme dhe qëndrueshme në mbrojtje të interesave të qytetarëve dhe pasurive natyrore të mbrojtura nga ligji dhe konventat arriti të finalizohej me suksesin dhe certifikimin e vendimit të Gjykatës së Lartë të 24 Nëntorit 2022.
Kjo çështje dhe kauzë ia doli të triumfojë në sajë të bashkëpunimit të ngushtë midis aktorëve dhe grupeve të interesit të përfshirë në të, të cilët i bashkoi nevoja për drejtësi, mbrojtja e pasurisë natyrore, e drejta mjedisore, rezistenca qytetare dhe ekspertiza ligjore. Centre for Legal Empowerment vlerëson maksimalisht rezistencën e banorëve e cila e kombinuar me përkushtimin e avokatëve, para-ligjorëve dhe aktivistëve arriti të prodhonte një vendim të drejtë dhe në favor të interesit qytetar.
Vendimi i datës 24 Nëntor është një gur i rëndë në vendosjen e precedentit dhe praktikave që do të shërbejnë në të ardhmen si instrument për mbrojtjen e mjedisit dhe kauzave të drejta qytetare.

On November 24, the Supreme Court decided to revoke the license of the concessionaire company for energy production in the Zajs HPP. This decision of the Supreme Court marks a victory to the several year effort of the residents of Zall Gjoçaj in Mat, and the legal support that the Center for Legal Empowerment has given to their right and environmental cause. Since 2019, we have been engaged in supporting the residents of Zall-Gjoçaj who, through civil resistance and legal assistance from our activists and lawyers, oppose the construction and operation of the HPP in the territory of the natural wealth of the park “Lurë – Deja”. Center for Legal Empowerment and its lawyers, thanks to their unsparing commitment to the civil and environmental cause at the same time, have managed to curb through arguments, based on the law, the energetic activity of the HEC in question. This journey has recognized achievements and successes one after another at all levels of the judiciary in the country, facing also unfavorable decisions to the just cause of the residents and community of Zall-Gjoçaj.
Center for Legal Empowerment along with lawyers and the support of activists and the local community continued the resistance regarding environmental justice. The first victory in this direction was recorded in January 2021, where the Administrative Court of Tirana annulled the decision that licensed the contracted company for the construction of the hydropower plant in the protected area, a decision that was upheld by the Administrative Court of Appeal in November 2021. In March 2022, the Supreme Court decided to suspend the execution of the decisions of the Administrative Court of First Instance of Tirana and the Administrative Court of Appeal, a decision for which, Center for Legal Empowerment decided to request a retrial.
Our unstoppable and sustainable effort to protect the interests of citizens and natural assets protected by law and conventions was finalized with the success and certification of the decision of the Supreme Court on November 24, 2022.
The success of this case was ensured thanks to the close cooperation between the actors and interest groups involved in it, who were united by the need for justice, protection of natural wealth, environmental law, civil resistance and legal expertise. Center for Legal Empowerment highly appreciates the residents’ resistance, which, combined with the dedication of lawyers, paralegals and activists, managed to produce a fair decision in favor of the citizen’s interest.
November 24th`s rulling is a step forward in setting the precedent and practices that will serve in the future as an instrument for the protection of the environment and civil rights causes.
